A Los Angeles County judge on Thursday issued a temporary restriction warrant against actor Olivier Martinez against his ex-wife, Oscar winner Halle Berry. According to People, the protective measure covers both Martinez and his 12-year-old son, Maceo, after the acts of alleged physical abuse filed by the actor.
As part of the temporary order, the court temporarily modified the visits regime to maintain communication between the actress and the minor: Berry will be able to see her son on Monday and Tuesday, as well as on Saturdays and Sundays, from 10:00 am to 8:00 pm.
At the same time, he rejected a request from Martinez to submit the actress to sobriety supervision checks, considering that there were not enough evidence to justify it.
Finally, the temporary restriction order will remain in force at least until the next 16th of October, when a final hearing will be held to decide whether the measure becomes permanent.
According to court documents submitted on October 1, Martinez alleged that Berry caused him “emotional and mental distress due to physical abuse of our younger son, Maceo.”
The actor detailed a supposed incident in which the actress allegedly grabbed him from the neck and began strangling him while shouting phrases like: “Who is dominant now?
The actor’s legal defense said that previous incidents of physical aggression against the minor had been recorded over the past few years, as well as alleged episodes of verbal and emotional abuse against Martinez himself. His lawyer, Patrick Baghdaserians, stressed that the absolute priority is the safety and well-being of the child, seeking in addition that Berry receives the necessary support to tackle his problems.
The actress’s legal team rejected the allegations. Marina Beck, Berry’s lawyer, called Martinez’s petition “totally unfounded and deliberately misleading.” Despite being deeply saddened by the situation, the actress's representation assured that she will continue to fight firmly for her son's interests and to give him the love and support she needs.
This new legal conflict arises three years after the couple formally ended their divorce in 2023, following an eight-year dilated legal process that at the time established child maintenance payments and economic agreements derived from the actress's income.
The hearing on the restriction order is scheduled for October 16.
