A federal judge on Monday ordered the release of José Trinidad Rojas Pliego, one of the passengers in the van carrying Mexican worker Lorenzo Salgado Araujo, who passed away after being shot by immigration and customs enforcement service ( ICE ) agents during an operation in Texas, within 48 hours.

Judge Keith P. Ellison of the Southern District of Texas, who issued the ruling, ruled that Rojas Pliego's immigration detention constituted a violation of his legal right to fair trial under the Fifth Amendment.

The magistrate pointed out that this case is one of many similar petitions challenging the DHS's ( DHS) interpretation of federal law requiring immigration detention.

Riojas Pliego is still being held by ICE, but it hasn't been confirmed if he has been freed. According to the court order, the immigration authorities had discharge him within 48 hours and give his lawyers a heads-up regarding how the measure will be carried out.

The inspection is advancing.

Salgado Araujo, who passed away on July 7 after an encounter with ICE officials in Houston, was one of the travellers in the truck.

In front of his partner and his young son, Salgado Araujo, the father of three American citizens, was shot while driving to work. Less than a week later, Johan Sebastián Guerrero, a Colombian, was shot by immigration agents in Biddeford ( Maine ).

The passengers ' attorneys have argued that they were detained without having a sufficient legal foundation, while Rojas Pliego, among others, has questioned the official version of the government, which claims that the car was used as a threat against the agents.
