A Los Angeles County Court judge has extended a temporary removal order for domestic violence issued in relation to Halle Berry and her ex-husband Olivier Martinez, pending a resumed hearing scheduled for next week.

A court dispute has arisen over the custody of Maceo, the 13-year-old son shared by the couple. The controversy began when Martinez filed a petition, alleging that the Oscar-winning partner had physically assaulted the child on September 26 during a domestic discussion at her residence. Following the accusation, a magistrate awarded Martinez temporary primary custody of Maceo and imposed a restriction order, significantly limiting the time the actress and the child can spend together.

At a closed-door hearing at the Stanley Mosk Justice Palace, Martinez presented confidential testimony, reiterating his claims against the performer. However, Martinez's testimony was challenged by Berry's lawyer, Marina Beck, who produced a sworn statement signed by Martinez in September 2024. In the statement, Martinez had affirmed under oath that there was no prior history of domestic violence between them. When questioned about the discrepancy, Martinez confirmed the authenticity of his signature and acknowledged that the statement was accurate at the time of signing.

Berry's legal team has vehemently denied allegations of misconduct, labeling them as entirely unfounded and intentionally misleading. This week, both Maceo and Berry's partner, musician Van Hunt, have provided testimony to the court.

The court proceedings in the case are set to resume next Monday, with Nahla Aubry, the 18-year-old eldest daughter of actress Halle Berry, scheduled to make a remote statement. In a previously submitted letter to the court, Nahla stated that she had never observed any abuse by her mother. The upcoming court sessions will ultimately decide whether the temporary custody arrangements for Martinez remain in place or if the restrictions currently imposed on Halle Berry are modified.
