The American Civil Liberties Union (ACLU), the ACLU of Minnesota, Covington & Burling LLP, Greene Espel PLLP, and Robins Kaplan LLP filed a class-action lawsuit against the <a href="/topic/Trump">Trump</a> administration on behalf of three community members—and a group of similarly disadvantaged individuals—whose constitutional rights were violated by the US Immigration and Customs Enforcement (ICE) Service Immigration and Customs Enforcement (ICE), Customs and Border Protection (CBP), and other federal agents.

In the lawsuit, filed on behalf of three community members, all US citizens, the ACLU accused federal immigration agents of violating citizens' constitutional rights, arguing that Somali and Latino communities in the state have been disproportionately targeted.

The lawsuit, which names the Department of Homeland Security (DHS) and its secretary, Kristi Noem, as defendants, along with several other Customs and Border Protection (CBP) officials, point to what they describe as an “alarming pattern of abuse spearheaded by the Department of Homeland Security… that is fundamentally altering civic life in the Twin Cities and the state of Minnesota.”

According to the ACLU, over the past six weeks, the <a href="/topic/Trump">Trump</a> administration has increased the deployment of federal forces by thousands. Masked and uniformed federal agents have ignored basic human rights in their enforcement activities against Minnesotans, especially the Somali and Latino communities. "The <a href="/topic/Trump">Trump</a> administration has been clear in its attack on the Somali and Latino communities through Operation Metro Surge... calling Somalis 'trash.' Following <a href="/topic/Trump">Trump</a>'s comments, ICE and CBP agents have indiscriminately arrested Minnesotans without warrants or probable cause simply because the agents perceived them as Somali or Latino,” he charged. "The brutal DHS raids catch foreigners, including people with immigration status, without warrants or legal basis for their arrest. Furthermore, Their discriminatory practices also involve numerous US citizens, whom they shackle and scan for facial recognition, ignoring their US citizenship documentation," he quoted. In their lawsuit,the three Minnesotans challenge the government's policy of racial profiling, illegally seizing and arresting people without a warrant or probable cause. This constitutes a violation of the Minnesotans' constitutional rights to equal protection and not to be seized without reasonable cause. The plaintiff, Mubashir Khalif Hussen, is a 20-year-old US citizen. On December 10, 2025, he was on his way to lunch in the Cedar-Riverside neighborhood when he was stopped by several masked ICE agents. When Hussen realized he was being detained by ICE, he began repeatedly saying, “I am a citizen.” But the agents refused to check Hussen's ID. ICE agents put him in a van and took him to the Whipple Building in South Minneapolis. Only after handcuffing him, taking his fingerprints, and showing a photo of his passport to someone in the Whipple Building was he released. “At no point did any officer ask me if I was a citizen or if I had any immigration status,” Hussen said. “They didn't ask for any identifying information, nor did they ask about my ties to the community, how long I had lived in the Twin Cities, my family in Minnesota, or anything about my circumstances.” “The practices of ICE and CBP are illegal and morally reprehensible,” said Catherine Ahlin-Halverson, an attorney with the ACLU of Minnesota. “The conduct of federal agents—detaining Minnesotans through racial profiling and illegal arrests—constitutes a serious violation of the most fundamental rights of Minnesotans and has “Sowing fear among immigrant communities and neighborhoods. No one, including federal agents, is above the law.” “The government cannot detain or arrest people because of the color of their skin, nor can it arrest people without probable cause,” said Kate Huddleston, senior staff attorney with the ACLU's Immigrants' Rights Project. “These kinds of police state tactics contradict the basic principles of liberty and equality that remain the foundation of our legal system and our country.” “Minnesota residents are bravely standing up to the reign of terror unleashed by the <a href="/topic/Trump">Trump</a> administration,” said Robert Fram, senior staff attorney at Covington & Burling. “We are proud to support and assist them in any way we can.” “The massive presence of ICE agents as part of Operation Metro Surge has disrupted civic life in the Twin Cities. “Minnesota residents are at risk of being detained by ICE while going to work or shopping,” said Kshithij Shrinath, attorney at Greene Espel. “We will continue to support our community and the rule of law.”
