Joe Belgio, a retired veteran firefighter, filed suit after suffering permanent brain injuries attributable to raw oysters consumed at Gibsons Steakhouse in Oak Brook, Illinois. His lawyers maintain that the oysters were contaminated and were the main cause of his critical condition.

One year has passed since the incident, last June, when Belgio was enjoying a family dinner at the restaurant and began to feel unwell after consuming the oysters. The situation quickly deteriorated, leading him to suffer cardiac arrest and loss of consciousness, requiring resuscitation by his former fellow firefighters, ABC7 Eyewitness News reported.

Community and family responses

Belgio's fiancée, Melanie Stayer, along with friends and family, has launched a fundraising campaign to cover the medical and living costs of the man who was considered a pillar in his community.

"I want people to know that this can happen to anyone. It was a random day with a random man in a restaurant, where he wanted to celebrate life with his family, and life can change very quickly," Stayer said.

His lawyers described him as a strong, healthy man, who is now confined to a hospital bed. The lawsuit alleges that doctors identified in tests performed on Belgio several pathogens that are associated with shellfish contamination.

"He will most likely be bedridden for the rest of his life. He has severe brain damage, with very little cognitive ability, and will need lifelong care," attorney Scott O'Sullivan said.

Reaction of the restaurant and distribution company

Gibsons Steakhouse has refuted the allegations, noting that no other cases of illness have been reported and that there is no evidence that its establishment was responsible for Belgio's condition. Additionally, the lawsuit includes Supreme Lobster and Seafood Company, which has not yet offered comment.

As a result of his illness, Belgio is expected to require lifelong care, with severe brain damage and significantly reduced cognitive ability. His former coworkers are organizing support for his continued recovery, ABC7 Eyewitness News notes.

Belgio's attorneys warn about the dangers of consuming raw seafood and highlight that this case serves as a serious reminder of the vulnerability everyone can face in everyday situations. As the lawsuit moves forward, the community remains united to support Belgio's family.
